New I-9 Form FAQ

How Pending or Inflight I9s will be handled once New Form I9 edition is enabled for my account?

Use Cases:

• I9 has been initiated by Customer and Section 1 has been triggered before enabling the New I9 edition on October 19th, 2023.
  • Section 1 Invite has been received but the candidate and candidate started modifying but did not complete Section 1. And New I9 edition has been enabled for this customer.
    • Candidate can continue to use the Same Email Invite, Same Link
    • Link will open the new Form I9 Wizard Step 1 for candidate. Candidate will not notice any significant change in the process except for Section 1 UI changes as defined under Release Notes
  • Section 1 Invite has been received and candidate completed Section 1 using old I9 Format (2019 edition). Section 2 hasn't been started by Authorized Approver\ designee. And New I9 edition has been enabled for this customer.
    • Section 2 link will open New Form I9 edition and Authorized Approver \Designee can view the completed Section 1 as a new format.
  • Section 1 Invite received, and candidate completed Section 1 and Section 2 has been completed both in old format before turning on the New Form I9 feature.
    • No Change - Old Form will marked as completed.
  • Section 1 Invite received, and candidate completed S1 in old format and record made UCNS after enabling New Form I9 feature.
    • UCNS Record will stay in the old format.
  • Section 1 Invite Created and candidate completed S1 and Section 2 has been completed in old format and the record is Terminated after enabling New Form I9 feature.
    • Record Stays in Old Format ONLY
  • Section 1 Invite Created and candidate completed S1 and Section 2 hasn't been completed and the record is Terminated - This is not the correct use case as Pending Record can't be terminated.

Archived Record in the Old Format and Need for Update i.e., Supplement B (Section 3 update as called in old format)

Section3 Update = Supplement B as part of New Form I9

• Old Form I9 completed before 31st Oct or Before the new Form I9 feature was enabled (Old Archived Form I9 record may contain Old Preparer\Translators section and\or Section 3 update,)
• I9 needs to be updated for Section 3\Supplement B after 31st Oct or after New Form I9 Feature enabled.
  • Supplement B will be available to Authorized Representative to update the details.
  • Final PDF print will contain - Old Section 1, Old Section 2, Old Preparer\Translators if any , + Old Section 3 update if any + New 1 page Supplement B to provide most latest changes to be updated
• Section3 Update = Supplement B
  • Archived Form I9 Record will never change its version, just Supplement B will be new once New Form I9 feature is enabled.

Miscellaneous

• For any Form I9, if Section 1 has been completed \ triggered prior to 1st August 2023 or Hire Date\1st day of the job is prior to 1st August 2023
  • the record must be completed in old format ONLY.
